Your agreement with your Tutor
The following information includes the Terms that will govern your relationship with your Tutor. Jaderberg Krais act as agent for your Tutor and are authorised to enter into the Terms with you on your Tutor’s behalf, and to administer your agreement with your Tutor. It is important that you recognise that the Terms relate to the provision of tuition as between you and your Tutor, and not Jaderberg Krais.
- Your agreement with us
You undertake that save as required by law you shall not at any time disclose to any person any confidential information concerning our business or our Tutors.
You agree that you shall not engage or offer to engage any Restricted Person other than as agreed by us as agent for a Tutor in accordance with the Terms. You further agree other than through our agency not to introduce our Tutors to any other person for the purpose of providing tuition.
The restrictions accepted by you under this paragraph apply to you acting directly or indirectly and on your own behalf or on behalf of or in conjunction with any other person or firm.
In the event that you breach the provisions of this paragraph you will remain liable to us for a sum equal to the commission we would have earned but for such breach which you agree to pay us on demand together with our Costs.
The provisions of this paragraph will survive any purported or actual termination of your agreement with us.
- Liability
We will have no liability to you in relation to the provision of the tuition services by a Tutor. In the event that a replacement Tutor is required we will endeavour to provide a suitable alternative as soon as possible however we will have no liability to you for our failure to provide an acceptable Tutor.
- Data protection
You consent to our processing personal information, including sensitive personal data as defined by the Data Protection Act 1988 for administrative, legal, personnel and management purposes including providing such information to our suppliers and customers, regulatory authorities and potential purchasers. You agree that we can use your details to contact you from time to time regarding our other products and services
- Other provisions
If any provision of this is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of these Terms.
If you fail to make any payment due to us under these terms we may apply interest on the overdue amount at the rate of 4% per annum above Barclays Bank plc’s base rate from time to time. Such interest shall accrue on a daily basis from the due date until actual payment of the overdue amount, whether before or after judgment.
These Terms shall be governed by English Law.
- Interpretation
In these Terms the following words have the meaning set out below:
| Costs | all costs, expenses and fees, including legal fees and an amount in respect of our administration time, suffered or incurred by us in the enforcement of our rights under your agreement with us. |
| Restricted Person . | a Tutor and any tutor with whom we have worked at any time in the year prior to the date of this letter who is introduced to you directly or indirectly by a Tutor |
| Tutor | any tutor introduced to you by us either directly or indirectly (and Tutors shall be construed accordingly). |
References to ‘us’, or ‘we’ or ‘our’ are references to JK Tutoring Limited.
Terms of business between Tutors and Parents
- Your agreement with your Tutor
These Terms govern the relationship between you and your Tutor. Jaderberg Krais act as agent for your Tutor and are authorised, amongst other matters, to enter into these Terms and to agree the scope of the Engagement with you on your Tutor’s behalf. All of our Tutors provide Jaderberg Krais with a valid DBS before starting work with us and are responsible for keeping them up to date.
- Scope of Engagement
Where you arrange a trial Lesson fees are payable in advance.
If following a trial Lesson, or if no trial Lesson is taken, you decide to engage your Tutor and your Tutor agrees to the Engagement, Jaderberg Krais will consult you and your Tutor and confirm the extent of the Engagement. Jaderberg Krais will confirm the Engagement in writing.
- Lessons and Cancellations
You will liaise with your Tutor in relation to the arrangements for each Lesson. Where a Lesson is cancelled by you with less than 24 hours notice your Tutor is entitled to charge a full Tuition Fee in respect of that Lesson. Any Lessons agreed in addition to those confirmed in the Engagement will be notified to Jaderberg Krais by you and your Tutor.
- Study Environment
You will ensure that your Tutor is provided with a safe and quiet study environment appropriate for study and, unless agreed otherwise with your Tutor, that an appropriate and responsible adult is on the premises for the duration of each Lesson.
- Tuition Fees, Deposit and Payment
Tuition Fees are charged by reference to your Tutor’s hourly fee rate for each hour or part of an hour of attendance at Lessons. Jaderberg Krais will notify you of the applicable hourly fee rate. Your Tutor reserves the right to change the hourly fee rate on notice to you.
You will normally be required to pay a Deposit in advance of any Lessons being provided; the Deposit will be held by Jaderberg Krais and applied against your Tutor’s final invoice for Tuition Fees when an Engagement is terminated.
Jaderberg Krais will be responsible for invoicing Tuition Fees on behalf of your Tutor, which will normally be monthly in arrears. Tuition Fees are payable directly to Jaderberg Krais within 7 days of presentation of the invoice. Your Tutor shall be entitled to decline to attend Lessons where Tuition Fees are not paid and/or where a Deposit has not been paid.
- Liability
Subject to the remainder of this paragraph your Tutor’s liability under these Terms shall not exceed your Tutor’s hourly fee rate.
Nothing in these Terms limits or excludes your Tutor’s liability for any liability which cannot be limited or excluded by applicable law.
- Data protection
You consent to Jaderberg Krais processing personal information, including sensitive personal data as defined by the Data Protection Act 1988, for administrative, legal, personnel and management purposes.
- Termination
You may terminate the Engagement at any time by one month’s written notice.
Your Tutor may terminate the Engagement at any time on one month’s notice or immediately in the event of a breach by you of these Terms or the Tutor’s inability to continue to attend Lessons due to unforeseen circumstances.
- Other provisions
If you fail to make any payment due to under these Terms your Tutor may apply interest on the overdue amount at the rate of 8% per annum above Barclays Bank plc’s base rate from time to time. Such interest shall accrue on a daily basis from the due date until actual payment of the overdue amount, whether before or after judgment.
Any amendment to these Terms shall not be effective unless agreed with Jaderberg Krais in writing.
These Terms shall be governed by English Law.

In these Terms the following words have the meaning set out below:
Costs – all costs, expenses and fees, including legal fees suffered or incurred by your Tutor in the enforcement of your Tutor’s rights under these Terms.
Deposit – a deposit against Tuition Fees, normally equal to one month’s Tuition Fees or such other amount as shall be advised by Jaderberg Krais
Engagement – the programme of Lessons agreed between you and your Tutor including the frequency and length of Lessons and the term of Lessons.
Lesson – a single lesson provided by your Tutor under these Terms (and Lessons shall be construed accordingly).
Study Environment – the location at which the Lessons are to be provided.
Tuition Fees – the fees payable by you to your Tutor pursuant to these Terms.
Tutor – any tutor recommended by Jaderberg Krais who attends a Lesson with you or the relevant student to whom tuition is to be provided.
